Ready for some fine print? We’ve done our best to ditch the usual legal jargon and only use plain, clear language that’s easy for anyone to understand. Never hesitate to contact us if you have any questions!

Please remember that even though we’re going easy on the legalese, when you sign up for our hosting services, this policy is a binding contract between IvyCat and yourself.

IvyCat has the right to change this policy at any time. Don’t worry, we’re not up to any sneaky stuff! We’ll always send you an email notification when we make changes.

Payment Policies, Fees, Refunds and Terms of Agreement

You must pay in advance to receive hosting service from IvyCat. You will continue to be billed until you cancel your hosting account. You may cancel your account at any time. IvyCat has the right to terminate your account at any time if you violate any of our restrictions.

If you are unhappy with IvyCat’s services within the first 30 days of creating a hosting account with us, you may cancel it and receive a full refund for your hosting plan. Only your hosting plan will be refunded. Any other services you have purchased through IvyCat will not be refunded. We cannot provide refunds for any accounts that are over 30 days old. If IvyCat cancels your account due to a policy violation, you are not eligible for a refund.

IvyCat reserves the right to change its prices at any time. All monetary transactions are in $US dollars.

Account Cancellation

You can cancel your account at any time. If you want to cancel your account, please create a helpdesk ticket that includes your domain name, your reason for canceling, and the date you wish the cancellation to occur.

If IvyCat is ever sued or threatened with a lawsuit from a third party because of something you have done with our service, you agree to pay the entire bill if IvyCat is found liable or has to pay to settle the dispute. Not only do you agree to fully reimburse IvyCat for what it pays to settle a dispute or to satisfy a judgment, you also agree to cover IvyCat’s reasonable attorney fees and all other costs it accumulates in the course of defending itself.

Server Abuse Policy

Free Email Businesses

Sites that advertise or sell mailing lists, or provide “safe lists” or “free email” accounts are also strictly prohibited. We reserve the right to suspend any site we consider harmful to a server’s performance.

Mass Email Marketing Policy

IvyCat does not allow mass email marketing sites on its servers without written permission from our sales or support staff. It doesn’t matter if it’s opt-in email marketing. We simply do not allow sites to run email marketing lists from our shared hosting accounts or managed servers without our approval.

We’re not trying to be ogres, it’s just that spam is a very real problem on the Net, and we’re trying to do our part to:

  1. make sure our customers have the best experience possible, and
  2. eliminate the spread of unsolicited junk mail.

Spam Policy is committed to a zero-tolerance, anti-spamming policy. Under this policy, we strictly prohibit spam and any unsolicited commercial email, from being sent:

  • Over the network
  • By customers or any other users
  • By Reseller’s customers

We also prohibit using any network, whether or not it belongs to IvyCat, to send spam messages that advertise or mention a site that is hosted on an IvyCat server.

We will react swiftly and seriously to these violations.

If you violate our Spam Policy, we reserve the right to suspend your account and even terminate your service without prior notice.

Activities that this Spam policy covers:

  • Sending unsolicited commercial email
  • Cross-posting messages to a large number of Usenet groups
  • Posting obscene or threatening messages while using or referring to an email address or website URL hosted on IvyCat servers
  • Using IvyCat servers as a mail drop for receiving responses to any of the activities in this list

If your main domain or web hosting account is involved in spamming activities and your account is terminated as a result, you are not eligible for a refund. In this circumstance, you will also not be eligible for a refund for any additional services you have paid, such as installations of software, IP addresses, SSL certificates, etc.

If you are a reseller and one of your customers is involved in spamming, we will suspend their site, not your main web hosting account.

If you have any complaints or comments regarding spam on our network, please direct them via email to [email protected]. (Note: This email works for customers only.)

No Free Trial Accounts Policy

All resellers are strictly prohibited from setting up Free Trial accounts for their customers. It is also forbidden to use our resources to supply free hosting or free email services.

Free Trials and free accounts (subdomain or otherwise) expose our servers to severe abuse from hackers and spammers. If you are using a reseller plan to offer Free Trial accounts, or free email addresses or hosting, we will suspend your web hosting account, with or without notice. We take this very seriously. There are no exceptions to this rule.

Overselling Policy

IvyCat allows our resellers to oversell their web hosting resources. If we feel that your account is too oversold, we reserve the right to upgrade that account as needed, through consultation with you. This policy exists to prevent our clients from abusing IvyCat’s resources by overselling their own resources and negatively impacting other clients using the same server.

No Unlimited Disk Space or Unlimited Data Transfer Policy

IvyCat reserves the right to refuse service, suspend, or cancel your account if you use your reseller web hosting plan to promote any plan that offers accounts with unlimited disk space or unlimited data transfer.
